Terms used in the Privacy Policy

If you notice one of the following capitalized terms in the further part of our Privacy Policy, you should understand them in accordance with the following definitions:

a.        "Shop" - an online store whose main page is located at azzurra.com.pl .

b.        "Policy" - means this document, i.e. the privacy policy that you read,

c.        "GDPR" - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. You can find the text of the GDPR here ,

 

§ 3

Protection of personal data

1.       We process all personal data that you provide in the Store or that we collect about you when you use the Store as the Administrator in accordance with the GDPR.

2.       We use the technical measures required by the current provisions on the protection of personal data to prevent breaches of the security of personal data sent electronically, i.e. as part of our Store.

 

§ 4

Your rights regarding personal data

1.       We process your personal data, therefore:

a.       you have the right to access your personal data,

b.       you can rectify them,

c.       you can request the deletion of your personal data when the GDPR allows it,

d.       you have the right to limit processing, to the extent specified in the GDPR.

2.       In parts II - IV of the Policy, you will find information about additional rights. In some situations, you will have additional options.

§ 5

Right to object

1.       After providing us with your personal data or if we collect it ourselves, you can exercise your right to object. You have them in two situations when we process your personal data:

a.       for the purposes of direct marketing based on our legitimate interest; you do not have to justify such an objection;

b.       based on our other legitimate interests; such objection needs to be justified by your particular situation. Tell us why we should not process your data.

Complaint to the President of the Personal Data Protection Office

When contacting us, please note the following:

  1. Why do we need your data, i.e. for what purpose do we process it?

1)      Responding to your message and solving the case presented by you.

We have described them in § 4 and 5 of the Policy.

 

  1. Do you have to provide us with your details?

It is voluntary. However, without providing your contact details, we may not be able to resolve your case.

 

  1. On what legal basis do we process your data?

Article 6 par. 1 lit. f GDPR, i.e. our legitimate interest.  

 

  1. What is our legitimate interest?

Solving the case presented by you and replying to your message.

 

  1. Who will we transfer your data to?

1)      Entities hosting (storing) the Store or personal data for us.

2)      Entities operating the online store on our behalf.

 

  1. How long will we process your data?

For the time needed to resolve the case presented by you. Depending on its type, also for the time needed to prove that we have solved it, i.e. for the period of limitation of claims. 

§ 9

Registering an account in the Store and concluding sales contracts

 

If you register in the Store, pay attention to the following matters:

a.        Why do we need your data, i.e. for what purpose do we process it?

1)      Performance of the contract for setting up an account in the Store and individual contracts for the sale of products ,

2)      marketing consisting in matching the content to your previous activities in the Store, we can e.g. provide you with a list of products in the Store that may interest you or encourage you to continue shopping that you have not finished,

 

b.       What rights do you have?

We have described them in § 4 and 5 of the Policy. You can also exercise the right to transfer your personal data under the conditions set out in the GDPR. 

 

c.       Do you have to provide us with your details?

It is voluntary. Without providing them, however, you cannot set up an account in the Store and conclude sales contracts through it.

 

d.       On what legal basis do we process your data?

Article 6 par. 1 lit. b, c and f GDPR, i.e. performance of the contract we conclude with you, performance of obligations under the law and our legitimate interest.

 

e.       What is our legitimate interest?

Our legitimate interest is to conduct marketing activities described in point a.2 above.

 

f.        Who will we transfer your data to?

1)      Entities hosting (storing) the Store and personal data for us.

2)      Tool suppliers for:

a)       traffic analytics on the Store's websites,

b)      conducting marketing,

       ) sending newsletters .

3)      Couriers and the post office.

4)      Payment operators available in the Store.

 

g.        How long will we process your data?

By time:

1)      the duration of the contract to set up an account in the Store, individual sales contracts and the time necessary to demonstrate that we have performed them correctly. This time corresponds to the length of the limitation period for claims;

2)      conducting our marketing activities described in points a.3 above or until you object to further processing of your personal data for these purposes;

 

§ 10

Subscribing to the newsletter

 

If you subscribe to our newsletter, pay attention to the following:

a.        Why do we need your data, i.e. for what purpose do we process it?

Sending you marketing information via e-mail, analyzing whether you read our newsletters and which content you read most willingly. On this basis, we can also adjust the content of the newsletter to your interests.

 

b.        What rights do you have?

We have described them in § 4 and 5 of the Policy. You can also exercise the right to transfer your personal data under the conditions set out in the GDPR.

 

c.        Do you have to provide us with your details?

It is voluntary. However , without providing them, you will not be able to subscribe to our newsletter.

 

d.        On what legal basis do we process your data?

1)      Article 6 par. 1 lit. f GDPR, i.e. our legitimate interest.

2)      If you agree to receive marketing messages to your e mail address, the legal basis will also be art. 10 of the Act on the provision of electronic services and art. 172 of the Telecommunications Law . Remember that you can always withdraw your consent. If you want to do this, please contact us.

 

e.        What is our legitimate interest?

Improving our newsletter by analyzing whether you are familiar with its content and which messages you are most interested in and matching the content of our newsletter to your interests.

 

f.         Who will we transfer your data to?

1)      Suppliers of tools for sending newsletters ,

2)      Entities hosting (storing) the Store and personal data for us,

3)      Marketing agencies.

 

g.        How long will we process your data?

For the duration of our marketing activities or until you object to further data processing for marketing purposes, or until you withdraw your consent to send messages to your -mail address. Your withdrawal of consent does not affect the lawfulness of processing prior to withdrawal of consent.

§ 11

Access to the Store's website

Accessing the Store's website involves the processing of information contained in cookies by us. Cookies are saved on your end device (e.g. computer, tablet, smartphone), and then access to the information contained in them is obtained. These activities take place according to the rules described below.

What are cookies and why do we use them

2.       We store cookies on your computer, phone or tablet, and then we access the information contained therein for the purposes of:

    1. ensuring the proper operation of the Store, including maintaining your session,
    2. ensuring security when using the Store, in particular counteracting fraud, such as cross-site request forgery,
    3. marketing consisting in displaying you advertisements of our products on other websites, including social networking sites, in matching the products you have viewed in the Store,
    4. statistical and analytical purposes, in particular enabling the analysis of the way in which you use the Store.
  1. In the cases described in points b, c and d above, your personal data may be processed:
    1. we process them on the basis of our legitimate interest, i.e. art. 6 sec. 1 lit. f GDPR;
    2. our legitimate interest is to ensure security when using the Store, marketing our products that you have viewed in our Store and matching the advertisements displayed to you with your previous activities in the Store, as well as collecting statistical data on how you use our Store to optimize its operation;
    3. Your rights related to this processing are presented in § 4 and 5 of the Policy;
    4. remember that you can contact us at any time and object to the processing of your personal data - you do not have to justify such an objection.
    5. We will transfer your personal data to advertising network operators, including social networking sites;
    6. we will store them for the duration of our marketing or statistical and analytical activities, or until you object to further data processing for marketing purposes, or object to statistical or analytical purposes;
    7. the transfer of personal data outside the European Economic Area will be made after meeting the conditions allowing for such action. We will inform you about the occurrence of such a situation;
    8. providing this personal data is voluntary, and failure to provide it, e.g. by using appropriate blocking software, does not have any negative consequences; then you will not see advertisements of our products tailored to your activities in the Store, including the products you view.

 

§ 13

Types of cookies

There are several types of cookies in the Store:

a.       session cookies that remain in the memory of your web browser until it is turned off,

b.       temporary cookies, which remain in the memory of your web browser until the expiry of a predetermined time (maximum 2 years) remember that you can delete such files earlier yourself (in § 15 we indicate how to do it),

c.       constants that remain in the memory of your web browser until you delete them (in § 15 we indicate how to do it),

d.       external, they come from e.g. from suppliers of analytics tools in the Store.

How to block cookies

1.       You can configure your web browser so that it prevents the storage of cookies on your computer, phone or tablet. You can also use appropriate browser extensions or programs for this purpose.

§ 15

How to delete cookies

3.       You can configure your web browser to prevent cookies from being stored on your computer, phone or tablet.

4.       You can delete cookies after they have been saved by us. For this purpose, you can use: appropriate functions of the web browser, programs for this purpose or appropriate tools available as part of your operating system.

§ 16

Impact of changing browser settings on the use of the Store

Changing the configuration of your web browser to one that prevents or limits the storage of cookies may limit the functionality of the Store. Deleting cookies while using the Store may lead to similar effects. This means that some of our services will not be available without cookies, for example you may not be able to complete your purchases in our Store.

 

§ 17

Third party cookies

1.       Cookies placed on your computer, phone or tablet may come from other service providers. You can block them or delete them yourself from your device. We indicate how to do this in § 14 and § 15. These files are stored on your device for a different period of time, depending on the given file (maximum 2 years).

2.       The Store contains cookies provided by:
